Unconventional Litigation and Appeals



For over thirty years, we have represented children and parents in unconventional ligitation or appeals regarding adoption, surrogacy, foster care, and gay or lesbian parenting:

  • We have represented adults who needed or wanted to adopt another adult to establish a family relationship between the parties. We have represented grandparents in actions for adoption, custody, guardianship, or visitation against birth parents who did not want them to have access or legal rights to their children.

  • We have represented birth parents, who never knew or consented to the adoption of their child, to oppose or undo an adoption. We have represented adoptive parents who were fighting to keep their adopted child against challenges by birth parents. We have represented family relatives in adoption over the objections of incarcerated criminal birth parents.

  • We have represented children in legal purgatory with unmarried parents fighting for custody. We have represented children found to be abused or neglected against the foster care service agency, or the birth parents.

  • We have represented parents against their child's school system on matters of suspension, expulsion, transportation, special education and related services, admission or transfers to or between schools, and 504 accommodation plans.

  • We have represented gay and lesbian parents against discriminating public or private social service agencies. We have represented single and committed partners in adoption of each other. We have represented gay and lesbian parents in the adoption of children born to one or the other, or neither. We have represented gay and lesbian parents in surrogacy and international adoptions.

  • We have represented parents in many cases that have been taken on appeal. We have represented clients in adoption matters as high as the Maryland Court of Appeals, the District of Colombia Court of Appeals, and the United States Supreme Court. In almost all of those cases we have prevailed. Courts and attorneys have subsequently applied in other cases our legal positions or the resulting court rulings to help define or clarify the law to the benefit of adopted children, as well as both adoptive and birth parents.

We use creative approaches to meet the needs of our clients. We are determined and persistent in reaching their objective, regardless of how unconventional the objective may be or how high we must go to fight for it.
